1. Introduction Welcome to Demall. By accessing or using our website and services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order or using our services. If you do not agree with any part of these terms, please do not use our website or services.
2. About Demall: Demall is a printing and customisation business based in Ghana. We provide custom printing services, including material selection, sample design, physical sample approval, and bulk order printing. Our services are available to individuals and businesses across Ghana.
3. Eligibility By using our services, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- The information you provide to us is accurate and truthful
- You are not violating any laws or regulations in your jurisdiction
4. Orders and Acceptance
- All orders placed through Demall are subject to acceptance and availability
- Placing an order does not constitute a binding contract until we confirm acceptance
- We reserve the right to refuse or cancel any order at our discretion
- You will receive an order confirmation via email or phone once your order is accepted
- It is your responsibility to review your order details carefully before submission
5. The Order Process Our standard order process works as follows:
- Step 1: You choose your preferred material from our catalogue
- Step 2: You pay the sample fee to initiate the design process
- Step 3: We create digital soft copy designs and send them to you for selection
- Step 4: We print a physical sample and deliver it to you by bus for approval
- Step 5: Upon your approval, we proceed with the full bulk order printing
You are responsible for reviewing and approving each stage before we proceed to the next. Demall is not liable for errors in the final product if the customer has given approval at any stage.
6. Pricing and Payment
- All prices are displayed in Ghana Cedis (GHS)
- Prices are subject to change without prior notice
- A sample fee is required before any design or printing work begins
- Full payment or an agreed deposit is required before bulk printing commences
- We accept payment via MTN MoMo, Vodafone Cash, bank transfer, and other agreed payment methods
- All payments are non-refundable once work has commenced, except as stated in our Refund Policy
7. Sample Approval
- You must carefully review and approve both the digital design and the physical sample before bulk printing begins
- Once you give approval for the physical sample, Demall will proceed with the bulk order
- Any errors or dissatisfaction with the final bulk order that were present in the approved sample will not qualify for a refund or reprint at our expense
- It is your responsibility to check all details, including spelling, colours, sizes, and layout, before giving approval
8. Delivery
- Demall uses third-party transport services, including bus delivery for sample and order delivery
- Delivery timelines provided are estimates only and are not guaranteed
- Demall is not responsible for delays caused by third-party delivery providers
- Risk of damage or loss passes to the customer once the order is handed over to the delivery service
- Delivery charges, if applicable, will be communicated to you before dispatch
9. Cancellations
- Orders may be cancelled before the design process begins, with a full refund of the sample fee
- Once design work has commenced, the sample fee is non-refundable
- Once a bulk order has been approved and printing has begun, cancellations are not accepted
- To request a cancellation, contact us immediately at the details provided below
10. Intellectual Property
- Any designs, logos, or artwork you provide to Demall remain your intellectual property
- By submitting designs or artwork to us, you confirm that you own the rights to that content or have permission to use it
- You grant Demall a limited licence to use your submitted content solely for the purpose of fulfilling your order
- Demall retains ownership of all original designs created by our team
- You may not reproduce or use Demall’s original designs without our written permission
11. Customer Responsibilities As a customer, you are responsible for:
- Providing accurate order details, delivery addresses, and contact information
- Reviewing and approving designs and samples promptly
- Ensuring the content you submit does not infringe on third-party intellectual property rights
- Ensuring the content you submit does not contain illegal, offensive, or defamatory material
- Making payments on time as agreed
12. Prohibited Content Demall reserves the right to refuse any order that involves:
- Content that is illegal under Ghanaian law
- Content that is offensive, hateful, or discriminatory
- Content that infringes on the intellectual property rights of others
- Content that promotes violence, illegal activities, or harmful behaviour
- Any content that Demall deems inappropriate at its sole discretion
13. Limitation of Liability To the maximum extent permitted by law:
- Demall’s total liability to you shall not exceed the amount you paid for the specific order in question
- We are not liable for any indirect, incidental, or consequential damages
- We are not responsible for losses arising from events beyond our control, including natural disasters, strikes, or disruptions to transport services
- We are not liable for any business losses, loss of profits, or loss of opportunity
14. Indemnification You agree to indemnify and hold Demall harmless from any claims, losses, damages, or expenses (including legal fees) arising from:
- Your violation of these Terms and Conditions
- Your submission of content that infringes third-party rights
- Your misuse of our website or services
- Any false or inaccurate information you provide to us
15. Privacy Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
16. Changes to Terms Demall reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website with a revised date. - If a resolution cannot be reached, disputes shall be submitted to the jurisdiction of the courts of Ghana
19. Severability If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
20. Entire Agreement These Terms and Conditions, together with our Privacy Policy, Cookie Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and Demall regarding your use of our services.
